Terms of Use

1. Who we are and what Re:Form is

1.1 We operate Re:Form as a venue. We provide the technology to list, browse, and message about reformers. We do not take ownership of listed items unless we expressly state “Sold by Milaron”.

1.2 We may update Re:Form, add features, or change fees at any time. We may update these Terms by posting the new version on Re:Form. Your continued use after posting constitutes acceptance. You should check this page periodically.

2. Who sells the equipment

2.1 Each item is owned and sold by the Seller named on the listing. The Buyer and Seller contract directly with each other for the sale.

2.2 Milaron is the platform operator only. We have not inspected the items, we do not verify their condition, safety, history or fitness for purpose, and we do not transfer title.

2.3 Australian Consumer Law: If a Seller is in trade or commerce, guarantees under the Australian Consumer Law may apply and cannot be excluded. If you are a private seller, you must still not engage in misleading or deceptive conduct. All items are second-hand and sold in their existing condition unless otherwise agreed between Buyer and Seller in writing on the Platform.

3. Accounts and sign-in

3.1 You must be 18 years or older to use Re:Form.

3.2 Passwordless sign-in: You sign in via a one-time code sent to your email address, or via your existing Milaron account where available. Codes expire quickly and are single-use.

3.3 Your responsibilities: You must provide accurate information, keep your email account secure, and not share codes. You are responsible for all activity under your account. You must not create more than one account or allow others to use it. Notify us immediately at contact@milaron.com.au if you suspect unauthorised access.

3.4 We may refuse service, suspend or terminate an account at any time if we reasonably believe there is a breach, fraud, safety risk, or misuse.

3.5 You may delete your account at any time by contacting us at contact@milaron.com.au.

4. Listings and moderation

4.1 Listings are published by the Seller and are the Seller's responsibility.

4.2 You warrant that you lawfully own the item, it is not stolen, not subject to a security interest that prevents sale, and is not subject to a recall that makes it unsafe to sell. You must include true photos of the actual item and accurately describe brand, model, age, condition, defects, damage, wear, missing parts, modifications, and service history.

4.3 Moderation after publication: Listings go live when you publish them and are then subject to moderation by Milaron. We may, without prior notice, unpublish, edit, or remove any listing, and suspend or remove any account, if we reasonably consider that it breaches these Terms, our Posting Guidelines, any law, or creates risk. This includes misleading listings, duplicate listings, prohibited items, suspected stolen goods, spam, or abusive conduct.

4.4 We do not guarantee any listing will remain available. We may retain removed listings and related data for legal, safety and compliance purposes.

4.5 You grant Milaron a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display your listing content for operating and promoting Re:Form.

5. Messages

5.1 Stay on Re:Form: For safety and evidence, all Buyer-Seller communication about a Re:Form listing must stay within Re:Form messaging. Do not attempt to move conversations off-platform to circumvent monitoring.

5.2 Contact details are hidden: To reduce scams and spam, Re:Form may automatically detect and hide email addresses, phone numbers, social handles, and links in messages. The other party will not see the masked details.

5.3 We can read messages for moderation: You acknowledge and agree that Milaron may access, store and review messages and other content on Re:Form for safety, fraud prevention, moderation, dispute handling, and compliance with these Terms and the law. Do not share bank account, card, or other sensitive financial information in messages.

5.4 No automated messages: You must not use bots or automated tools to send messages or respond to inquiries.

6. Milaron Delivery

6.1 Delivery is an optional, separate service that Milaron may quote for on request. It is not included in the sale between Buyer and Seller.

6.2 If you request delivery, we will provide a separate written quote. If you accept, your contract for delivery is with Milaron under the Delivery Terms provided with the quote. That delivery contract is separate from the sale contract.

6.3 Buyer and Seller must both confirm in writing on Re:Form that delivery can proceed and who is paying for it. You must ensure the item is accessible, safe to handle, and prepared as instructed by us. Reformers are heavy - manual handling risks apply.

6.4 Delivery fees are payable to Milaron as set out in the quote and are separate from the price Buyer pays Seller for the reformer.

7. Buying from a seller

7.1 Direct sale: Any sale is a private contract between Buyer and Seller. Milaron is not a party, does not act as agent for either party, does not process payment for the reformer, does not hold funds in escrow, and does not provide buyer protection for the sale price.

7.2 Inspection: Buyers must make their own enquiries. Inspect the reformer in person where possible and satisfy yourself as to condition, completeness and safety before paying. Sellers' photos and descriptions are not verified by Milaron.

7.3 Payment and collection: Price, payment method, and collection arrangements are to be agreed directly between Buyer and Seller via Re:Form messaging. Title and risk transfer as agreed between them.

7.4 Disputes: Any dispute about the item, price, condition or collection is to be resolved directly between Buyer and Seller. If Australian Consumer Law applies, the Seller must honour applicable guarantees. You may report an issue to us at contact@milaron.com.au so we can consider moderation action, but we are not required to resolve private sale disputes.

8. Liability

8.1 Re:Form is provided “as is” and “as available”. We do not warrant that it will be uninterrupted, secure or error-free.

8.2 To the maximum extent permitted by law, Milaron is not liable for any listing, user content, or sale between users, including any loss arising from inaccurate descriptions, defects, failure to pay, or injury from handling or use of equipment.

8.3 Nothing in these Terms excludes any non-excludable guarantee under the Australian Consumer Law. If we are liable for breach of such a guarantee, our liability is limited, at our option, to resupply of the Re:Form services or payment of the cost of resupply.

8.4 To the maximum extent permitted by law, our total aggregate liability for all claims arising from Re:Form is limited to the greater of $100 or the amount you paid to Milaron for Re:Form in the 12 months before the claim. For Milaron Delivery claims, liability is limited to the delivery fee paid for that job.

8.5 To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, including loss of profit, revenue or data.

8.6 You agree to indemnify and hold harmless Milaron, its directors, officers and employees from any claim, loss or cost, including reasonable legal fees, arising from your breach of these Terms, your listing or item, your violation of any law, or your dealings with another user.

8.7 Safety: Reformers are heavy, mechanical items. Use appropriate care when inspecting, moving and using second-hand equipment, and see our Safety and Anti-Scam Guide. Milaron is not liable for personal injury arising from handling or use of equipment sold via Re:Form.

9. Changes, contact and governing law

9.1 Prohibited uses: You must not use Re:Form for any unlawful purpose, infringe intellectual property, harass or abuse others, post false or misleading information, upload viruses, scrape, crawl, or attempt to interfere with the Platform.

9.2 Privacy: Your personal information is handled under our Privacy Policy. By using Re:Form you agree to that handling, including monitoring of messages as described in clause 5.

9.3 Changes: We may change or discontinue Re:Form or any feature at any time.

9.5 Governing law: These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.

9.6 Severability: If any provision is unlawful or unenforceable, it will be severed to the minimum extent necessary and the remaining provisions continue in effect.
